    Criminal Law and Procedure -- 1964 Tennessee Survey

    The substantive criminal law receives little attention from the Tennessee appellate courts. No doubt this observation would be equally true of most jurisdictions. To one who received his legal training in a common law system of criminal law and who yet has had some experience with Canada\u27s federal code of criminal law, the emphasis on criminal procedure is surprising. Does this mean that the state codes of substantive law have reached such heights of perfection and expertise that the efforts of the Model Penal Code draftsmen are unnecessary or, at best, academic? It is unlikely. The position rather reflects a preoccupation with constitutional rights and a criticism of the present law of criminal procedure. This accentuation is not unexpected in the light of the great activity of the United States Supreme Court in the field of constitutional criminal procedure in recent years

    Association between genotypic diversity and biofilm production in group B Streptococcus

    Background: Group B Streptococcus (GBS) is a leading cause of sepsis and meningitis and an important factor in premature and stillbirths. Biofilm production has been suggested to be important for GBS pathogenesis alongside many other elements, including phylogenetic lineage and virulence factors, such as pili and capsule type. A complete understanding of the confluence of these components, however, is lacking. To identify associations between biofilm phenotype, pilus profile and lineage, 293 strains from asymptomatic carriers, invasive disease cases, and bovine mastitis cases, were assessed for biofilm production using an in vitro assay. Results: Multilocus sequence type (ST) profile, pilus island profile, and isolate source were associated with biofilm production. Strains from invasive disease cases and/or belonging to the ST-17 and ST-19 lineages were significantly more likely to form weak biofilms, whereas strains producing strong biofilms were recovered more frequently from individuals with asymptomatic colonization. Conclusions: These data suggest that biofilm production is a lineage-specific trait in GBS and may promote colonization of strains representing lineages other than STs 17 and 19. The findings herein also demonstrate that biofilms must be considered in the treatment of pregnant women, particularly for women with heavy GBS colonization

    Temperature-dependent Hall scattering factor and drift mobility in remotely doped Si:B/SiGe/Si heterostructures

    Hall-and-Strip measurements on modulation-doped SiGe heterostructures and combined Hall and capacitance–voltage measurements on metal-oxide-semiconductor (MOS)-gated enhancement mode structures have been used to deduce Hall scattering factors, rH, in the Si1 – xGex two-dimensional hole gas. At 300 K, rH was found to be equal to 0.4 for x = 0.2 and x = 0.3. Knowing rH, it is possible to calculate the 300 K drift mobilities in the modulation-doped structures which are found to be 400 cm2 V – 1 s – 1 at a carrier density of 3.3 × 1011 cm – 2 for x = 0.2 and 300 cm2 V – 1 s – 1 at 6.3 × 1011 cm – 2 for x = 0.3, factors of between 1.5 and 2.0 greater than a Si pMOS control

    HadISD: a quality-controlled global synoptic report database for selected variables at long-term stations from 1973--2011

    [Abridged] This paper describes the creation of HadISD: an automatically quality-controlled synoptic resolution dataset of temperature, dewpoint temperature, sea-level pressure, wind speed, wind direction and cloud cover from global weather stations for 1973--2011. The full dataset consists of over 6000 stations, with 3427 long-term stations deemed to have sufficient sampling and quality for climate applications requiring sub-daily resolution. As with other surface datasets, coverage is heavily skewed towards Northern Hemisphere mid-latitudes. The dataset is constructed from a large pre-existing ASCII flatfile data bank that represents over a decade of substantial effort at data retrieval, reformatting and provision. These raw data have had varying levels of quality control applied to them by individual data providers. The work proceeded in several steps: merging stations with multiple reporting identifiers; reformatting to netCDF; quality control; and then filtering to form a final dataset. Particular attention has been paid to maintaining true extreme values where possible within an automated, objective process. Detailed validation has been performed on a subset of global stations and also on UK data using known extreme events to help finalise the QC tests. Further validation was performed on a selection of extreme events world-wide (Hurricane Katrina in 2005, the cold snap in Alaska in 1989 and heat waves in SE Australia in 2009). Although the filtering has removed the poorest station records, no attempt has been made to homogenise the data thus far. Hence non-climatic, time-varying errors may still exist in many of the individual station records and care is needed in inferring long-term trends from these data.     Layer-based coding, smoothing, and scheduling of low-bit-rate video for teleconferencing over tactical ATM networks

    This work investigates issues related to distribution of low bit rate video within the context of a teleconferencing application deployed over a tactical ATM network. The main objective is to develop mechanisms that support transmission of low bit rate video streams as a series of scalable layers that progressively improve quality. The hierarchical nature of the layered video stream is actively exploited along the transmission path from the sender to the recipients to facilitate transmission. A new layered coder design tailored to video teleconferencing in the tactical environment is proposed. Macroblocks selected due to scene motion are layered via subband decomposition using the fast Haar transform. A generalized layering scheme groups the subbands to form an arbitrary number of layers. As a layering scheme suitable for low motion video is unsuitable for static slides, the coder adapts the layering scheme to the video content. A suboptimal rate control mechanism that reduces the kappa dimensional rate distortion problem resulting from the use of multiple quantizers tailored to each layer to a 1 dimensional problem by creating a single rate distortion curve for the coder in terms of a suboptimal set of kappa dimensional quantizer vectors is investigated. Rate control is thus simplified into a table lookup of a codebook containing the suboptimal quantizer vectors. The rate controller is ideal for real time video and limits fluctuations in the bit stream with no corresponding visible fluctuations in perceptual quality. A traffic smoother prior to network entry is developed to increase queuing and scheduler efficiency. Three levels of smoothing are studied: frame, layer, and cell interarrival. Frame level smoothing occurs via rate control at the application.     The Framing Effects of Professionalism: Is There a Lawyer Cast of Mind? Lessons from Compliance Programs

    Professionals working inside companies may bring with them frames of mind set by their professional experience and socialization. Lawyers, in particular, are said to think like a lawyer -to have a lawyer cast of mind. In seeking power within a company and in exercising the power that they obtain, professionals may draw on their professional background to frame, name, diagnose, and prescribe a remedy for the company\u27s problems. In making decisions about their compliance with the law, companies are constrained not only by their environment, but also by their agents\u27 understanding of whose (or what) interests the company should serve. In particular, compliance managers\u27 understandings will frame and influence their companies\u27 calculations of the value, benefits, and costs of compliance activities. The profession of the compliance manager then may influence how the company complies with the law. This Article uses data from a survey of 999 large Australian businesses to examine the professional background of the person in charge of compliance and (1) how they analyze the costs, benefits and risks of non-compliance; and (2) their company\u27s structures and practices of compliance. Contrary to our hypotheses, we find that the professional background of the individual responsible for compliance has little impact on a company\u27s compliance management structures and practices or assessment of stakeholders. The exceptions are that having a lawyer in charge of compliance is associated with the company\u27s perception of heightened legal risk; and where the person in charge of compliance is a lawyer, the company compliance efforts will be marked by manuals and training programs, but not more fulsome compliance structures, which are present when a compliance specialist leads the department. Unfortunately, our data also reveals that these compliance structures are generally merely formal-and likely largely symbolic
